Roman";color:black'>It seems that if you spread slurry during the closed period and NIEA get to hear about it, they will come out and do a Nitrates-type inspection on your farm.<span Ulster Farmers Union has welcomed the Environment Ministers advice that farmers may on an individual basis spread slurry beyond the 15 October Nitrates Action Programme deadline, if they can record reasonable circumstances why they were unable to meet the slurry spreading deadline. <o:p></o:p></span></p> <p class=MsoNormal style='mso-margin-top-alt:auto;mso-margin-bottom-alt:auto'><span style='font-size:14.0pt;font-family:"Arial","sans-serif";mso-fareast-font-family: "Times New Roman"'>UFU President John Thompson said he was encouraged that the demands of practical farming had been acknowledged and there was now flexibility for farmers who for genuine reasons will be unable to meet this weekend s slurry spreading deadline.&nbsp; <o:p></o:p></span></p> <p class=MsoNormal style='mso-margin-top-alt:auto;mso-margin-bottom-alt:auto'><span style='font-size:14.0pt;font-family:"Arial","sans-serif";mso-fareast-font-family: "Times New Roman"'>John Thompson said;  Some farmers have been facing a very difficult dilemma because they have slurry to spread but the persistent wet weather has prevented them from carrying out this work.&nbsp; The last day for spreading before the closed period begins is this Saturday but on-going wet weather, delayed farm work and poor ground conditions means some farmers will simply be unable to empty their slurry stores and prepare properly for the winter.&nbsp; The UFU has been in discussions with the EU Commission in Brussels and with DARD and DOE locally, outlining the problem which farmers face and it is a relief to see a solution emerge.&nbsp; Farmers who genuinely will be unable to get their slurry out before the weekend now have the option of delaying their work until the weather and ground conditions improve.&nbsp; I would also encourage our members to document the reasons why they delayed slurry spreading beyond the 15 October deadline as this may be required later .&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; quality while also acknowledging the practical challenges which farmers face.&nbsp;&nbsp; We have always opposed inflexible deadline dates in the Nitrates Action Programme; farmers can t simply farm Environment Minister Alex Attwood today stated that where farmers have reasonable excuse for not complying with the closed period, they can spread slurry beyond the deadline of 15 October. <br> The Minister recognises that some farmers have faced difficult circumstances this summer preventing them from spreading slurry. These circumstances include cases of flooding and inability to harvest crops.<br> Alex Attwood said<span class=GramE>:</span><br>  I appreciate the difficulties faced by farmers in a number of places in Northern Ireland. I have examined the Met. Office weather records over the last weeks and months. I continue to do so.&nbsp; <b style='mso-bidi-font-weight: normal'>On this basis and at this time the general evidence does <u>not</u> support the view that there are very widespread exceptional circumstances to change the closed period.</b><br> <b style='mso-bidi-font-weight:normal'>However, I made it clear to the UFU that, where farmers have good reason and had grounds for their actions this would inform how my Department subsequently assesses compliance with the Nitrates Action Programme</b>. I want to be clear  I will be supportive of farmers to the limits of my office. <br> <b style='mso-bidi-font-weight:normal'>I made it clear to NIEA that where individual farmers have taken all reasonable steps to manage the situation and had no alternative, the Agency should look positively at those cases. In these circumstances penalties may not apply </b><br> The farmers will however have to demonstrate that they managed their slurry properly.<br> Where it comes to the attention of NIEA that a farmer has spread slurry over the closed period, NIEA officers will do the following:-<o:p></o:p></span></p> <p class=MsoNormal style='mso-margin-top-alt:auto;mso-margin-bottom-alt:auto'><span style='font-size:14.0pt;font-family:"Arial","sans-serif";mso-fareast-font-family: "Times New Roman"'>" &nbsp;Visit the farm in question<span class=GramE>;</span><br> " &nbsp;Check for evidence of water pollution arising from the spreading;<br> " &nbsp;Ascertain the circumstances that led to the farmer spreading slurry or manure during the closed period;<br> " &nbsp;Confirm the evidence that the farmer had taken all reasonable steps to manage the situation, and had no alternative. Such evidence would include that the farmer had sufficient slurry storage under normal conditions, and had been properly managing slurry outside the closed period. Clean storm water, <span class=SpellE>eg</span>, roof water, should be diverted from slurry storage tanks<span class=GramE>;</span><br> " &nbsp;In addition, it will be expected that slurry had been spread on low risk land and that steps had been taken to protect watercourses. It would also be expected that farmers would not totally empty tanks  they should only remove enough slurry to provide adequate containment for immediate needs.&nbsp;&nbsp; <br> Notes to editors<span class=GramE>:</span><br> 1.&nbsp;The Nitrates Action Programme Regulations (NI) 2010 (NAP Regulations) specify a closed period for the spreading of livestock manures, except dirty water, from midnight on 15 October to 31 January.&nbsp; This measure promotes best practice to obtain maximum benefit from nutrients in those manures for crop fertilisation whilst protecting the environment.<o:p></o:p></span></p> <p class=MsoNormal style='mso-margin-top-alt:auto;mso-margin-bottom-alt:auto'><span style='font-size:14.0pt;font-family:"Arial","sans-serif";mso-fareast-font-family: "Times New Roman"'>2.&nbsp;As well as not spreading in the closed period, other measures in the NAP Regulations relating to environmental conditions must be met.<o:p></o:p></span></p> <p class=MsoNormal style='mso-margin-top-alt:auto;mso-margin-bottom-alt:auto'><span style='font-size:14.0pt;font-family:"Arial","sans-serif";mso-fareast-font-family: "Times New Roman"'>3.&nbsp;Environmental conditions include<span class=GramE>:</span><br> " &nbsp;Slurry must not be spread when the soil is waterlogged, flooded (or likely to flood), if heavy rain is forecast within 48 hours, where land is steeply sloping with a significant risk of water pollution occurring or when land is frozen or snow covered.&nbsp;&nbsp; <br> " &nbsp;slurry must not be spread within 10m of a watercourse, 20m of a lake and 50m of a borehole, spring or well.<br> " &nbsp;slurry must be spread using inverted splash plates, trailing shoe, trailing hose, soil injection or soil incorporation methods. <br> " &nbsp;<span class=GramE>single</span> applications of slurry are limited to 50m 3 per hectare with a minimum of three weeks between applications.<br> The NAP Regulations also require farmers to put in place sufficient storage capacity for livestock manure.&nbsp; In the case of a pig or poultry enterprise this needs to be sufficient for at least 26 weeks and at least 22 weeks on all other farms.&nbsp; In addition, farmers need to ensure that their storage capacity is sufficient to meet periods of adverse weather conditions outside the close period.<o:p></o:p></span></p> <p class=MsoNormal style='mso-margin-top-alt:auto;mso-margin-bottom-alt:auto'><span style='font-size:14.0pt;font-family:"Arial","sans-serif";mso-fareast-font-family: "Times New Roman"'>4.&nbsp;The NAP Regulations were introduced to improve the use of nutrients on farmland and as a result improve water quality throughout Northern Ireland.<br> 5.&nbsp;DOE and DARD have joint responsibility for implementation of the NAP Regulations.&nbsp; DOE (through NIEA) is the competent authority for enforcement of the environmental aspects of the legislation including compliance with the closed period.<br> 6.&nbsp;Under exceptional circumstances, beyond the control of and not foreseeable by an individual farmer, a defence may be made for non-compliance with some of the requirements of the NAP Regulations including spreading organic manures during the closed period.
